Summerwind is being Developed by San Gorgonio Land LLC and Argent Management. The claim is that because the Developer still owns scraps of land around Beaumont’s Fairway Canyon Development, the Developers can claim 1,806 acre/feet per year of Water Rights for another Development.
Because the YCVWD Requires a Water Supply to Issue Will-Serve Letters and the BCVWD only Requires Bribes; the Developers want to Transfer the Paper Water Rights from Beaumont to Calimesa.
This is a continuation of the August 3, 2017 Meeting in which ‘Beaumont Representative’ Kyle Warsinski Voted to Transfer Beaumont’s Water to Summerwind Ranch Development.
Because of overgrowth; the Beaumont Basin has been in Overdraft for over a Decade. ‘Overdraft’ means that more water is being taken out of the Basin that put into the Basin.
In 2004 Beaumont City Attorney Joe Aklufi created STWMA, the Adjudication of the Beaumont Basin, and Watermaster to ‘legally’ Overdraft the Basin. There are legal reasons for an Adjudication, but Beaumont’s Adjudication was created for the purpose of circumventing State and Federal Laws.
The Adjudication of the Basin was filed on February 4, 2004. Fairway Canyon Area 19A Notice of Special Taxes was filed on December 15, 2004. Fairway Canyon has constructed over 1,000 houses and is planning to build a thousand more in the Fairway Canyon Development. Oak Valley Partners has no Water Rights to transfer – there’s not enough water to support the Houses they have planed in Fairway Canyon.
The Adjudication of the Beaumont Basin was illegal on its face and expired in 2014. The State and Feds are Investigating STWMA because all of the money came from Beaumont’s Bonds, Joe Aklufi has lost his License to practice Law, and he and the Expendable Seven that concocted the scam are awaiting Trail.
What is left of the Scam is thousands of houses without an adequate water supply, a rapidly depleting Safe Yield in the Beaumont Basin, and a Watermaster Board that still wants to continue the scam.
The Law Firm of Alvarado Smith has submitted a Memorandum without a signature. The Memo claims the ‘issue’ is whether the water rights from the 2004 Adjudication should be ‘prorated’ for the current Safe Yield.
No, that is not the issue. The issue is if it’s legal to continue to try to use the 2004 Adjudication of the Beaumont Basin to Transfer Paper Water in order to continue the Pass Area Construction Scam that has drained the Basin.
The answer is NO it is not legal to use a Fraudulent Adjudication as an excuse to transfer Water that does not exist. There is no ‘water being stored in the Beaumont Basin’ – the Beaumont Basin is in Overdraft and was already in Overdraft when the 2004 Adjudication was created.
