Plea for State Treasurer to Assume Role of Trustee and Agent

RE: City of Beaumont

I am once again appealing to the State Treasurer’s Office to assert its rights as defined in California Government Code 12333 et seq.

On March 15, 2016 City Attorney John Pinkney told a fanciful story that Union Bank, Beaumont’s Bond Trustee, doesn’t use computers, just throws Bond Requisitions in boxes, and allowed outsiders to enter the Trust Department of the Union Bank Building in Long Beach, and copied Beaumont’s Bond Documents.

It is unknown if Union Bank ever released Beaumont’s Mello Roos Documents or if Union Bank actually released the Documents and Pinkney destroyed them.

On April 5, 2016 Beaumont Consultants Webb & Associates submitted a Report stating that “Union Bank, the City’s Mello Roos Bond Trustee, has disclosed that many of the records related to this project have been destroyed..” : http://www.ci.beaumont.ca.us/DocumentCenter/View/27328

On Tuesday, May 3, 2016, Beaumont City Council was presented with $16 Million more Mello Roos Bond for Fairway Canyon Development Area 19B that will be illegally traded for Mitigation Fees. The number of houses is not listed, only the amount of Bond Debt.

Both the City of Beaumont and Union Bank destroyed all Mello Roos Bond Documents in an attempt to hide criminal activity.

California Government Code 12333 (a) states: “The Treasurer may act as trustee, registrar, paying agent, tender agent, custodian, depository, transfer agent, fiscal agent, or in any fiduciary or representative capacity for any purpose permitted by law..”

California Government Code 12333 (b) (a) states: “the Treasurer may exercise all powers that may be exercised by any private person, corporation, bank, trust company, or legal entity in this state.”

I am requesting the State Treasurer’s Office act as Beaumont Mello Roos Bond Trustee and Agent as both the City of Beaumont and Union Bank have abandoned their duties as Trustee and Agent.
