Beaumont Acting City Attorney Pinkney Cites Fear of Lawsuit in Pre-Closed Session.

In the Pre-Close Session Transcript Pinkney tells Council that former City Manager Alan Kapanicas will sue if his employment is terminated. Pinkney considers this ‘significant exposure’.
#1: Kapanicas’ Contract states that it can be terminated with a 30-day notice.
#2: Private Sector/Public Sector – when an employee breaks State and Federal Law man ever created and embezzles millions of dollars their Contract is null and void.
#3: It cost $25,000/month to keep Kapanicas on the Payroll – far more than the price of litigation.
#4: Sue for what, stopping him from using his government position to funnel money to his private sector company? That’s not exactly lawsuit worthy.
#5: Kapanicas paying for his own legal fees to support his psychotic mindset might be the slap of reality that he needs.
It’s ridiculous that the line workers’ jobs are being cut in order to pay Kapanicas and Pinkney.

3:00 Pinkney: We are going into Closed Session on two Items. The first one is Item 1.a.; Conference with legal counsel anticipated exposure to litigation, Government Code Section 54956.9d. One (1) potential case; Alan Kapanicas adverses the City of Beaumont. This is not a pending litigation matter, it is a threatened litigation matter. It arises out of the fact that Mr. Kapanicas’ Attorney has threatened that Mr. Kapanicas will file suit against the City should it terminate Mr. Kapanicas’ employment with the City. And based on existing facts and circumstances surrounding this matter; there is significant exposure, in my view, to litigation against the City and for that reason we will be addressing that Item in Closed Session.
