Refusing to Release Public Records is a Big Red Flag that Elected & Appointed Officials are Violating State & Federal Laws.
I have received the CD from the City of Banning in Response to my Public Records Request dated August 3, 2016.
The Records Request is incomplete.
The City provided $2.3 Million in Requisitions from the 2005 Bond. The Requisitions show that all of the money was transferred to the City for ‘design’. The City will need to produce the Invoices and checks showing payment of funds.
The City included a General Ledger that only contained a few deposits. Even Bill Aylward, who will spend the rest of his life in prison, was able to maintain and produce a General Ledger.
There were no Bank Statements provided. Banning City Staff claim that all bank statements are sent from the Financial Institutions through the mail. The Banning Staff has committed perjury and forged a government document.
The State ONLY transmits LAIF documents electronically. Bond Trustees ONLY transmit Bond Fund Accounts electronically .
Every Member of Council is copied on this Records Request because it is Council that is responsible for their Staff’s actions. It is assumed that the Council knows their financial records are not being properly maintained in violation of State and Federal Laws, which will prompt State and Federal Investigations and prevent the City of Banning from acquiring additional Bonds in the future.
My Public Records Request is now 45 Days overdue. There is no provision under the law for corrupt and incompetent elected and appointed officials to stall and/or refuse to release Public Records, as a matter of fact there is a name for such actions; Obstruction of Justice.
Refusing to release public records is a big red flag that the elected and appointed officials are conspiring to violate State and Federal Laws.
1. General Ledgers for last Seven (7) Fiscal Years. I want every transactions recorded for every Account from 000-0000-000 to 999-9999-999.
2. Bank Statements from every Financial Institution for the past Seven (7) Years.
3. All Requisitions from Every Bond Fund Account for the 2005 and the 2015 Bond.
4. All Invoices and Checks showing payment of any/all Requisition Funds transferred to City.
5. Employee Roster listing Employee Name, Job Title, and Start Date.
6. All Communication to/from Every Council Member, Staff Member, Lawyers, and/or Consultants regarding my Public Records Request from August 3, 2016 to Present.
