City Claims to Have No Idea What the FBI Confiscated
When the State and Federal Government confiscate property from the private or public sector they must list every item confiscated from the person/business/agency raided.
The DEA publishes their list of confiscated items: http://www.forfeiture.gov/pdf/DEA/OfficialNotification.pdf
A Public Records Request was submitted for the Riverside District Attorney and the FBI’s List of Item confiscated from the City of Beaumont, Office of Urban Logic Consultants, Home of Alan Kapanicas, Home of Ernest Eggers, Home of Dave Dillion, Home and Office of James Gregg.
The City of Beaumont replied that they have no such list and “ ..a local agency has no duty to create a record that does not exist at the time of the request.”
The Document has ‘existed’ since April, 2015.
Apparently the City of Beaumont is so incompetent that they never even asked what the State and Feds confiscated. It is also apparent that the City’s Attorney that was gifted his position has no knowledge of State and Federal Laws.
The State and Feds gave the City a list of what was confiscate – it’s part of their job.
The City needs to hire an honest Attorney that understands California State Law regarding Public Records Requests.
California Penal Code 1535: “When the officer takes property under the warrant, he must
give a receipt for the property taken (specifying it in detail) to the person from whom it was taken by him, or in whose possession it was found; or, in the absence of any person, he must leave it in the
place where he found the property.”
Private Sector, Public Sector; White Collar or Blue Collar crimes are all treated the same.
Produce the Records.
