State Law clearly Explains the Duties of the City Treasurer

For the past 8 years the position of Beaumont City Treasure was held by Robert Deming, who is the husband of Rebecca Deming, who is a former Urban Logic employee that was gifted the position of ‘Beaumont Director of Planning’.

Nancy Carroll won the 2014 election with 2/3’s of Beaumont Voters demanding a real City Treasurer to account for the money. We could all see by Council and Staff’s treatment of Nancy Carroll at the last Council Meeting that City Staff and Council are going to attempt to keep Nancy Carroll from doing her duties.

Both the positions of City Treasurer and City Clerk are listed in the Beaumont Municipal Code:

2.08.010 Composition: The officers of the city shall consist of a city council composed of five members, a city clerk, a city treasurer, a chief of police, a recorder, a city attorney, a street superintendent, a health officer, a pound master, and such other officers as the city council may from time to time deem necessary or expedient. (1913)

However; the descriptions of the City Treasurer and City Clerk have been removed. I’m sure that in their simple little minds removing the job descriptions from the Municipal Code somehow erased the positions, but California State Law clearly spells out the position of City Treasurer:

California Government Code
41001: The City Treasurer shall receive and safely keep all money coming into his hands as treasurer.

41002: He shall comply with all laws governing the deposit and securing of public funds and the handling of trust funds in his possession.

41003: He shall pay out money only on warrants signed by legally designated persons.

41004: Regularly, at least once each month, the city treasurer shall submit to the city clerk a written report and accounting of all receipts, disbursements, and fund balances. He shall file a copy with the legislative body.

41005: The city treasurer shall perform such duties relative to the collection of city taxes and license fees as are prescribed by ordinance.

41006: The city treasurer may appoint deputies for whose acts he and his bondsmen are responsible.

41007: The deputies shall hold office at the pleasure of the city treasurer and receive such compensation a is provided by the legislative body.
