Stand Up For Your Rights!

On Tuesday, January 22, 2014 Beaumont City Council passed Agenda Item 7.C. The City is implementing maintenance regulations on private property that are far more restrictive than California State Law.

Under the new ordinance the City will be able to penalize the Property Owner $1,000 for the 1st offense if their grass is over 3” tall. It is a violation
of State and Federal law to place unreasonable restrictions and penalties upon the citizenry.

The State of California already has a Maintenance Building Code listed under California Health & Safety Code Division 13 Section 17000 – 19997.  The State of California is considered one of the most regulated States in the Union.  Our laws are already more stringent than the International Code the Council wants to enact.

There have been no (zero) reports or complaints put before Council or the City concerning lack of maintenance codes or substandard housing; therefore it is
correctly assumed by most residences that the City plans to use this as a way to illegally access private property, target harassment of citizens speaking out against the City, and to increase revenue with excessive fees.

The local agencies can pass no laws or ordinances that infringe on the Citizens’ State and Federal rights to privacy, private property, and equal protection under the law.  The State Attorney General’s Office and the FBI have already been notified as to the City’s intent.  If the City passes this ordinance they will be monitored in detail.  Each week we will request a copy of the actions taken by the City in regards to the maintenance code that will include the name of person submitting a complaint, the Property Owner targeted, all actions taken and fees imposed.

To All Property Owners: If the City attempts to enter your property under the guise of ‘Code Compliance’:

Call 911 Immediately. Request the presence of a County Sheriff and keep 911 on the line to record the event.

Identify the City Worker: Make them write down their name, job title, and the reason they are attempting to gain access to your private property. Also record the
vehicle license number, date, and time of the incident.

If Fines or Penalized: You have the right to appeal in County Court to oppose the ticket. The situations will not hold up in court because they violate State and
Federal Law. Contrary to what was stated by the City – they can not be their own justice system.

Our State and Federal Constitutions demand that all Elected and Appointed Officials provide the citizenry with equal protection under the law.  Any Official that carries out the bidding for the City will be prosecuted under State and Federal law for Conspiracy of and Violations of our State and Federal Civil Rights.
