Solera Sues Their Insurance Companies to Recoup $1 Million

Solera’s Dirty Board & Dirty Lawyer is Costing their Retirement Community Over $1/2 Million/Year Defending the Board’s Illegal Activity.

Solera Oak Valley Green is Suing Liberty Insurance and Indemnity Insurance for $500,000 each for Breach of Contract, Tortious Breach of Contract, and Unfair Competition

Solera is suing their Insurance Companies to recoup the money wasted on fighting Lawsuits against Solera Residents Aristea and Paul Hupp.

Item 9 on the Lawsuit states: “Solera tendered dense of the Hupp Actions to the Insurers under the Policies. The claims in the Hupp Actions, and the allegations upon which those claims are based, fell within the Liberty Policy’s coverage for “any actual or alleged error, misstatement, misleading statement, act, omission, neglect, or breach of duty.”

“Similarly, the claims in the Hupp Actions fell within the Philadelphia Policies’ coverage for “personal and advertising injury”.

Since 2015 Solera’s Board has spent over $1,000,000 in legal fees defending their illegal actions. If Solera had an honest lawyer; the issues with the Hupps would have been resolved, not escalated to multiple lawsuits.

Solera didn’t make ‘a’ mistake or error; Solera has been on a two-year crusade against the Hupp Family. Solera has denied the Hupp family access to their property and discriminated against their chosen breed of dogs.

Solera’s Board and Legal Counsel knew or should have known at some point in the last two years that their actions were illegal; but it’s Beaumont, so Solera had the support of the Beaumont Police Department. The City of Beaumont has paid $20,000 in Legal Fee to City Attorney John Pinkney’s Law Firm for the Hupp Lawsuits and an outside Law Firm.

The problem with hiring Wal-Mart style lawyers is that they’re creating a job for themselves, which rarely results in sound legal advise.

Solera Oak Valley Greens is a Senior Citizen Retirement Community that shouldn’t be running up $500,000/year legal fees. Solera just needs an honest local Lawyer on retainer, if such a creature exists in today’s society.
