NOTICE OF VIOLATIONS, WASTE DISCHARGE REQUIREMENTS ORDER NO. R8-2016-0026 FOR THE CITY OF BEAUMONT SEWAGE TREATMENT PLANT NO. 1, 417 4th STREET, BEAUMONT, CALIFORNIA, (NPDES NO. CA33101001)

Dear Ms. Gibbs:

The City of Beaumont (City) owns the Beaumont Wastewater Treatment Plant (Facility), a tertiary treatment facility located in the southern portion of the City. Waste discharge requirements, including reporting requirements for the Facility are specified in Order No. RS-2015-0026, NPDES No. CA01 05376 (Order). The Order stated that the Facility’s design and permitted flow is 4 million gallons per day.
In our November 20, 2015 letter (enclosed) we reminded you of the standard provision in Section VI.A.15 of the Order that requires the City of Beaumont to file a written report with the Regional Board within ninety (90) days after the average dry-weather waste flow for any month equals or exceeds 75 percent of the design capacity of the waste treatment and/or disposal facilities. A report transmittal letter signed by the senior administrative officer must include a certification that the policymaking body is adequately informed in the matter.

To date, we have not received the required report. The City has violated and continues to violate reporting requirements specified in Section VI.A.15 of the Order.
Further, we understand that the current capacity of the plant does not meet the current growth of the City and immediate repairs and maintenance are required at the Facility. By not addressing necessary repairs and maintenance and the lack of planning for adequate treatment capacity, the City also threatens to violate discharge prohibitions specified in Section Ill of the Order.

The City is required to submit the required report no later than May 19, 2016. Failure to submit the requested information may result in enforcement action, including civil monetary penalties pursuant to Water Code section 13385 of up to $10,000 for each day of violation. Please note that issuance of this notice does not preclude further enforcement action in this matter.
