WRCOG Specifically EXCLUDES Beaumont’s use of Civil Code Section 3287(c)

2014-08-06-aThe City of Beaumont’s web page ‘Just the Facts’ states: “Today’s rate of .11% on a $43 Million Judgment is $47,000 annually or $130 daily, not the rumored 10% annually as suggested by some.”

The City’s website further states “PROOF” and quotes Civil Code Section 3287(c).

The WRCOG vs City of Beaumont Judgment was very clear that the City would not be able to utilize Civil Code 3287(c):

“As stated above, the total amount of TUMF required to be remitted by Beaumont vs WRCOG is $42,994,879. Beaumont shall also pay interest on that sum at the STATUTORY RATE from October 2009 to May 22, 2014. Petitioner shall submit a declaration accompanying proposed judgment showing the amount of interest and how it is calculated.
The Court finds and determines that this proceeding is not a “tax or fee claim against a public entity,” pursuant to Civil Code 3287(c) …”
The City of Beaumont did not have to print a statement that they knew was a lie, but the City and Council always lies to the Public.
