The Water District has brought back two request for ‘Will-Serve’ Letters on Wednesday night’s Agenda.

5. Consideration of Request for Updated Will-Serve Letter for Ongoing Development within K Hovnanian Homes – Four Seasons at Beaumont Development (Tract 33096-5) **(pages 61-105)

6. Consideration of Request for Updated Will-Serve Letter and Annexation for Sunny-Cal Specific Plan Project Tentative Tract Map 36583 (Located South of Cherry Valley Blvd./North of Brookside Ave./West of Hannon Rd./East of Interstate 10 Freeway) **(pages 106-115)

Will-Serve Letters for 172 K. Hovnanian houses and 497 Sunny-Cal houses.

The K. Hovnanian Reports state:

“As of the December 10th, 2014 Board Meeting, BCVWD’s General Manager, Eric Fraser had attempted to schedule a meeting with the City of Beaumont City Manager, Alan Kapanacis to determine the City of Beaumont’s plans for their recycled water usage, however, the City Manager identified via email that he did not deem a meeting was necessary at this time, and provided supporting documentation identifying that the City’s official position was to provide recycled water to the District.

Mr. Fraser subsequently identified to the City Manager, that on January 15, 2013, the Beaumont City Council resolved to revoke any and all offers made in writing by the City with respect to making recycled water available to Beaumont-Cherry Valley Water District.

It was Staff’s position at that time that the City subsequently identified their intent for their planned usage of recycled water when the City included a draft Recycled Water Agreement with the Morongo Band of Mission Indians for the Morongo Golf Club at Tukwet Canyon Golf Course (Item 6.a.7) in the City’s November 18th, 2014 City Council Meeting Agenda. The Draft Recycled Water Agreement (Pages 1-4 only) and associated Staff Report provides are attached for reference and provides an understanding of the City’s plan for usage of their recycled water.

It is Staff’s belief that the direction of the Board of Directors to Mr. Fraser had been met prior to the December 10th, 2014 board meeting and therefore, the request for an updated “Will Serve Letter” was resubmitted at that time for consideration by the Board of Directors.”

The Morongo Recycled Water Scam was pulled from the Agenda when the Morongo Tribe found out it was a scam. Water District Board Member John Convington is also the Tribe’s Services Administrator, so he should be fully aware of the situation between Beaumont and the Tribe.

The Sunny-Cal report states:

“Consideration of request to provide an updated “Will Serve Letter” for the proposed Sunny-Cal Specific Plan Project, Tentative Track Map 36853 and approval for annexation for the property associated with TTM 36853 with the Local Agency Formation Commission (LAFCO).”

There’s no reason to go further. Beaumont has no fire stations, no recycled water plant, they never built the roads, and two state agencies are regulating the City’s Sewer Plant. LAFCO will not allow any more building in Beaumont until their infrastructure is built.

The Sunny-Cal property is in Cherry Valley. The rule in Cherry Valley is one house per acre. Sunny-Cal is 192.61 acres, so they are legally allowed to build 192 houses. BCVWD can issue Sunny-Cal ‘will-serve’ letters for 192 houses, but there’s no need to waste any more time living out the fantasy that LAFCO will allow Sunny-Cal to be annexed into the City of Beaumont and build another 497 houses.

If Sunny-Cal wants their Mitigation Fees embezzled and to build houses in a City without infrastructure, then they can buy property in Beaumont – Area 5 is perpetually for sale. But they can’t build 497 houses on 192 acres in Cherry Valley and they knew it when the purchased the land.
